Judicial Panel to Reexamine Ruling That Allowed Trump to Send Military Forces to Oregon City

The ninth circuit court has maintained a ban on sending state troops in the Oregon city, after a recent legal decision.

Appeals Court Concurs to Rehear Case

The federal appeals court ruled on this week that it would reexamine the case concerning the president’s authority with an expanded panel of eleven justices. The court also vacated a earlier ruling from a smaller judicial group that had supported the administration.

Ongoing Dispute Over Troop Deployment

This legal directive represents the latest development in a long-running court case over whether the administration has the legal right and justification to deploy national guard forces in Portland. Approximately 200 federalized guard members have been in limbo since the end of September when the mobilization attempt was initiated in response to months of protests.

Conflicting Arguments

The administration has argued that federal officials at the ICE facility in south Portland were facing threats, while local authorities maintain that local officers have control of the situation.

Contrary to characterizations of the city as a conflict zone, residents have been sharing videos of lush hiking trails and a vibrant culinary culture, and planning activities such as an protest bicycle event against the “militarization of our city”.

Court Proceedings

The appeals court decision came after a US district judge in the city enacted two legal injunctions this month – one preventing the federal control of the Oregon national guard, and another prohibiting the use of any military personnel in Oregon, after efforts to evade the first order by calling up troops from California.

On the previous day, the appeals court had put the first ruling on hold – allowing command of 200 Oregon national guard – but the second ruling remained in place, preventing the actual deployment of the forces.

En Banc Review

The Tuesday decision means the matter will be heard by the full court – with all decisions under consideration together – by a group of 11 judges.

“This ruling demonstrates that facts are important and that the judicial system are working to hold this administration accountable. The constitution restricts the executive authority, and local populations cannot be treated as a training ground for unchecked federal authority,” stated the legal representative in a statement.

“The court is sending a definite signal: the president cannot dispatch the armed forces into American urban areas without cause. We will continue protecting state legislation, values, and autonomy as this case moves forward and our fight continues in the judicial system.”
